
AGREEMENT OF TERMS & CONDITIONS

By submitting a payment to The Luxurious Escape specifies that you have read and understood these Terms and Conditions and that you agree to these Terms and Conditions.
All services will require a contract signed by the client sent to the email on file detailing the services rendered and the business relationship.
Please understand that at any time,The Luxurious Escape has the right to change and/or edit our Terms & Conditions and pricing without any notice to consumers.
Legal action will be taken in case of fraudulent charge-backs, harassment via online, email or phone and any form of threats.
We have the right to decline any client. Any unaccepted price quotes and/or invoices are canceled within 72 hours. After 7 days of no communication the client will have to pay an additional consultation fee as prices for lodging and flights fluctuate requiring additional pricing research.
PAYMENTS & PRICING
All services are to be paid in full at the time of booking within the specified time from 72 hours. There are no discounts on pricing unless a specific promotion code is entered and applicable for the said service. Pricing is based on market value and is subject to change without notice.
Flight and lodging quotes are subject to change daily; it is recommended to pay for flights and lodging as soon as possible to avoid any significant price increase.
PAYMENT PLANS
All Payment Plans will be based on a third party payment plan servicer. The payment plans are based on your credit eligibility and you may not be approved. All payment plans will incur an additional processing fee ranging from $6-$10 + 6% of the total amount.
REFUNDS
Deposits and payments are 100% Non-Refundable.
Due to the fact that we provide a custom service, the time that it takes to create the travel designs is non-refundable.
The Luxurious Escape does not provide refunds for any services unless agreed upon. Having buyers remorse or wanting to use another company instead is not a suitable means for a refund.
TIMELINE
Once payment has been made to The Luxurious Escape , the travel design process will begin in the time frame given to the client. Most quotes are given within 48 hours of paying your consultation fee. In the rare event that additional days are needed, The Luxurious Escape will contact you with a specific timeframe. Most fully customized itineraries are given within 10 days of paying your booking fee. In the rare event that additional days are needed, The Luxurious Escape will contact you with a specific timeframe.
Flights and Lodging must be booked within 45 - 60 days of departure. If you are hiring The Luxurious Escape for an itinerary less than 45 days from departure, flights and lodging must be booked within 14 days of hiring The Luxurious Escape. If you are hiring The Luxurious Escape for an itinerary less than 30 days from departure, flights and lodging must be booked within 7 days of hiring The Luxurious Escape. Deviating away from these timelines without direct notice to The Luxurious Escape will result in additional rush research fees starting at $30.
No additional activities or any trip extras will be booked unless flights and lodging have been secured. Flights and lodging must be secured first before any other trip needs are confirmed.
CHANGES
If additional people are added to a group for a fully customized itinerary, a charge of $75 will be required to accommodate additional research and rework of the travel design. For example: If a travel design is booked for 2 people and a third person is added at a later date, an additional charge of $75 will be imposed. Even if the travel design is booked for the 1-4 people price point, any changes made to the amount of persons after agreeing to the contract terms will require an additional $75.
Once a trip location has been agreed upon for travel, any changes to the location will require an additional $100 fee for research and rework.
Once trip dates have been agreed upon for travel, any changes to the trip dates will require an additional $50 fee for research and rework.
If an entire trip has to be canceled due to the client’s request, the trip may be rebooked within 60 days free of charge as long as the trip’s destination is the same. Any deviations to the destination will incur a $100 fee.
TERMINATION OF SERVICES
The client has 5 days to respond to our emails. After this grace period, the client and travel agency relationship will be terminated and the client will be required to pay a restart fee of $50. Waiting on responses/decisions hinders us from catering to our other clients and business needs.
**This agreement can also be terminated by The Luxurious Escape for the following reasons:
1. Financial instability of clients.
2. Service requests that were not in the original travel design agreement.
3. Making unreasonable requests in an impossible time frame.
4. A client that is unable to make decisions.
5. Overly-contact and harassment from clients.
6. Client deemed difficult to work with.
The termination will be given in writing immediately upon termination and no type of debating will be acknowledged.
GHOSTING CLAUSE
Any client who books a service and disappears after 7 days of no show , no call, no response--you will receive 2 follow up emails. If emails are not responded to after a 5 day period and no formal agreement has been made between the client and The Luxurious Escape, services will be deemed as fortified and no refund will be provided. If Client would like to continue, a restart fee of $75 will be charged before any new services are rendered.
COMMUNICATION
All communication is done strictly via email and/or the website.. We do not answer inquiries about trips on any other platform. The Luxurious Escape will only communicate with the client listed on the contract, no outside parties. The Luxurious Escape will respond during business hours and in the event of peak season within 24 hours.
Please be advised that The Luxurious Escape caters to multiple clients in parallel and response times may vary depending on the volume of clients in a given week.
